These Terms of Service (“Terms”) govern the use of the AI Blogging Tool (“Service”) provided by Tosten Marketing LLC (“Company,” “we,” “us,” “our,” or “company”). By accessing or using the Service, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service immediately.

1. Use of the Service

1.1. The Service is designed to assist with content generation but does not replace human review and editorial oversight. 1.2. You agree to use the Service responsibly and comply with all applicable laws and regulations. 1.3. The Company reserves the right to modify, suspend, or terminate the Service at any time without notice.

2. User Responsibilities

2.1. You acknowledge that content generated by the Service may require review, modification, or verification before publication. 2.2. You assume full responsibility for the content published using the Service and any claims arising from such content. 2.3. You shall not use the Service for unlawful, fraudulent, defamatory, or misleading purposes.2.4. Any external links generated by the Service are provided as-is, and you are responsible for verifying their accuracy, relevance, and compliance with applicable laws. The Company is not responsible for the content of any external websites linked through the Service.

3. Intellectual Property

3.1. The Company retains all rights, title, and interest in and to the AI Blogging Tool, including but not limited to its software, algorithms, and related technology. 3.2. Users receive a license to use the content generated by the Service however they want, as long as they remain a Tosten Marketing LLC customer. 3.3. You must ensure that any content generated does not infringe on the intellectual property rights of third parties.

4. Disclaimers and Limitation of Liability

4.1. The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose. 4.2. The Company shall not be liable for any errors, inaccuracies, or unintended consequences arising from the use of the Service. 4.3. In no event shall the Company be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or reputational harm.

5. Indemnification

5.1. You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, including but not limited to:

• Copyright infringement
• Defamation claims
• Misleading or false advertising claims
• Regulatory or legal violations

6. Termination

6.1. The Company reserves the right to suspend or terminate your access to the Service for violations of these Terms. 6.2. Upon termination, you must cease all use of the Service, and any stored data may be deleted at the Company’s discretion.

7. Governing Law & Dispute Resolution

7.1. These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles. 7.2. Any disputes arising from these Terms shall be resolved through binding arbitration in Washington State, except where prohibited by law.

8. Modifications to Terms

8.1. The Company reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

9. Term & Cancellation

Our services are provided on a month-to-month basis with no long-term contracts. You may cancel at any time by providing written notice before your next billing cycle. The setup fee is non-refundable. Upon cancellation, your services will remain active until the end of the current billing period, and no further charges will be incurred. We do not offer refunds for partial months of service.

Client-Specific Modifications.
These Terms of Service constitute the entire agreement between Tosten Marketing and the Client unless otherwise expressly modified in a written agreement or written email confirmation issued directly by Tosten Marketing. Any such modification shall apply only to the specific Client identified and shall not alter or amend these Terms for any other client or generally.
